A McDonough County jury found Timothy Smith guilty but mentally ill Wednesday afternoon for the violent murder of his cellmate, Macomb native Darrell Hocker.
The verdict came after a three-day trial, Smith’s second, following a hung jury in his initial June 2025 trial. Hocker was killed in his jail cell during the early hours of Nov. 8, 2023.
Smith, who did not attend or participate in the trial, pleaded not guilty by reason of insanity through his attorney. However, the state argued that despite Smith’s mental health issues, he understood the criminal nature of his actions when he murdered Hocker. The jury agreed.
Smith faces 20 to 60 years in the Illinois Department of Corrections, to be served at 100 percent. A sentencing hearing is scheduled for Oct. 16 at 9 a.m.
McDonough County State’s Attorney Matt Kwacala thanked the Illinois State Police and McDonough County Sheriff’s Department for their assistance. He also acknowledged the Hocker family for their close involvement and patience throughout the legal process.
